These general terms and conditions of sale and use (the "Terms") govern the use of the website coulange1918.com (the "Site") and the sales of products concluded on the Site between Maison Coulange and any natural person acting for purposes outside their trade or profession (the "Customer").
Article 1 – Identification of the seller
The Site is published and operated by COULANGE INTERNATIONAL SAS, a French simplified joint-stock company with a share capital of 20,000 euros, registered with the Paris Trade and Companies Register under number 915 060 206, whose registered office is located at 57 boulevard Pereire, 75017 Paris, France ("Coulange").
Customer service: info@coulange1918.com – +33 1 84 60 81 65.
The Site is hosted by Shopify International Limited, 2nd Floor, 1-2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland.
Article 2 – Scope and acceptance
The Terms apply to every order placed on the Site. They are accessible at any time on the Site and may be printed or saved. The Customer declares that they have read and accepted them before confirming their order. The applicable Terms are those in force on the date of the order.
The Customer declares that they are of legal age and have the legal capacity to enter into contracts.
Article 3 – Products
Coulange pieces are made in France. Their essential characteristics (materials, composition, colours, sizes, care) are presented on each product page. Photographs and the on-screen rendering of colours may differ slightly from reality, and Coulange cannot be held liable on that account.
Products are offered while stocks last. If a product becomes unavailable after the order, the Customer is informed and refunded without delay.
Article 4 – Prices
Prices are stated inclusive of all taxes, in the currency displayed for the selected delivery country. Delivery is free of charge. For deliveries outside the European Union, customs duties and import taxes are included in the price paid at the time of the order (shipped DDP): no additional charge is requested from the Customer upon receipt.
Coulange may change its prices at any time. Products are invoiced at the price in force at the time the order is confirmed.
In the event of an obvious error in the displayed price (a derisory price or one bearing no relation to the value of the product), in particular due to a technical or input error, Coulange may cancel the order and refund the Customer in full, as no sale can be formed on an erroneous price.
Article 5 – Orders
The Customer selects their products, checks the details of their order and its total price, corrects any errors, then confirms their order and proceeds to payment. Placing the order constitutes acceptance of the prices and product descriptions.
Coulange acknowledges receipt of the order by e-mail. The contract is concluded when this confirmation e-mail is sent. Coulange may refuse or cancel an order in the event of an existing dispute with the Customer, non-payment or a legitimate suspicion of fraud.
Products are sold for personal use. Coulange may limit the quantities per order or per Customer and refuse orders placed for resale purposes. In the event of doubt as to the Customer's identity or the regularity of the payment, Coulange may suspend shipment and request proof of identity and address; failing a response within 7 days, the order may be cancelled and refunded.
The data recorded by Coulange constitute proof of the transactions concluded. The contract is archived by Coulange and the Customer may access it upon simple request to customer service.
Article 6 – Payment
Payment is made online, at the time of the order, by bank card or by any of the other payment methods offered when the order is confirmed. Transactions are secured and encrypted by our payment service providers; Coulange never has access to the Customer's full bank card details.
Retention of title. The products remain the property of Coulange until full and effective payment of the price. In the event of an abusive objection to or dispute of the payment after delivery, Coulange may demand the return of the products.
Article 7 – Delivery
Products are delivered to the address provided by the Customer when placing the order. In metropolitan France, orders are shipped via Colissimo or DHL, with delivery approximately 48 hours after dispatch. Internationally, shipments are entrusted to DHL Express; delivery times vary according to the destination. A tracking number is sent by e-mail as soon as the order is dispatched.
Failing an agreed date, products are delivered no later than 30 days after the conclusion of the contract. In the event of delay, the Customer may, after having called upon Coulange to make the delivery within a reasonable additional period, terminate the contract under the conditions set out in articles L. 216-6 et seq. of the French Consumer Code.
The risk of loss and damage passes to the Customer when the Customer, or a third party designated by them, takes physical possession of the products. The Customer checks the condition of the parcel upon delivery. If the parcel has been opened, is damaged or is incomplete, the Customer records specific reservations with the carrier and informs customer service within 48 hours, with supporting photographs, in order to enable Coulange to exercise its rights of recourse against the carrier.
Article 8 – Right of withdrawal
The Customer has a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to give reasons for their decision or bear any costs other than those provided for by law. Where the order relates to several products delivered separately, the period runs from receipt of the last product.
To exercise this right, the Customer notifies their decision by means of an unequivocal statement sent to info@coulange1918.com, or by using the withdrawal form set out in the appendix. The Customer then returns the products without undue delay and no later than 14 days after communicating their decision. Return costs are borne by Coulange.
Coulange refunds all sums paid, including delivery costs, no later than 14 days from the day on which it is informed of the Customer's decision. The refund may be withheld until the products have been received back or until the Customer has supplied proof of having sent them back. It is made using the same means of payment as that used for the order, unless the Customer expressly agrees otherwise.
Products must be returned unworn, unwashed and unaltered, with their labels and in their original packaging. The Customer may try them on as they would in a shop. Any diminished value resulting from handling other than what is necessary to establish their nature, characteristics and functioning (prolonged wear, odours, stains, removed labels, alterations) renders the Customer liable: Coulange may then deduct from the refund an amount corresponding to the loss of value observed.
In accordance with article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply to pieces made to the Customer's specifications or clearly personalised, in particular made-to-measure pieces.
Article 9 – Satisfaction guaranteed or your money back
In addition to the right of withdrawal, Coulange grants the Customer a period of 30 days from receipt of their order to return a product with which they are not satisfied. The product must be returned unworn, unwashed and unaltered, with its labels and in its original packaging; failing this, the return may be refused and the product sent back to the Customer. Returns are free of charge and the refund is made to the means of payment used for the order, after inspection of the product. This commercial offer does not apply to made-to-measure or personalised pieces. Coulange may refuse the benefit of this offer in the event of repeated or abusive returns, without prejudice to the statutory right of withdrawal.
Article 10 – Legal guarantees
The consumer has a period of 2 years from delivery of the goods to invoke the legal guarantee of conformity in the event of a lack of conformity appearing. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
The legal guarantee of conformity entails an obligation on the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within 30 days of their request, free of charge and without major inconvenience to them. If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a 6-month extension of the initial guarantee. If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of 2 years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if the professional refuses to repair or replace the goods, if the repair or replacement of the goods takes place after a period of 30 days, if the repair or replacement of the goods causes major inconvenience to the consumer, or if the lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity. The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious as to justify an immediate price reduction or termination of the contract. In that case, the consumer is not required to request repair or replacement of the goods first. The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the guarantee that remained to run until the reconditioned goods are delivered.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300 000 euros, which may be increased to up to 10 % of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects pursuant to articles 1641 to 1649 of the French Civil Code, for a period of 2 years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
Article 11 – Implementation of the guarantees
Any claim must be sent to customer service at info@coulange1918.com, together with the order number, a description of the defect and photographs. Coulange may request the return of the product for examination by its workshop before any repair, replacement or refund.
The following do not constitute a lack of conformity or a hidden defect: normal wear and tear of the product and of natural materials (patina, softening, slight variations in shade), damage resulting from an accident, abnormal use or care not in accordance with the instructions on the label and the product sheet, and modifications or alterations carried out by a third party.
In accordance with article L. 217-12 of the French Consumer Code, Coulange may decline to proceed in the manner chosen by the Customer if the requested remedy is impossible or entails disproportionate costs compared with the other option.
Article 12 – Repair service
Maison Coulange offers a repair service for its pieces, under the terms set out on the dedicated page of the Site. This commercial service is separate from the legal guarantees and does not replace them. Coulange assesses the technical feasibility of each intervention and may, outside the legal guarantees, make it subject to a prior quotation.
Article 13 – Liability and force majeure
Coulange is liable for the proper performance of the obligations arising from the contract, under the conditions provided for by law. It cannot be held liable where the non-performance is attributable to the Customer, to the unforeseeable and insurmountable act of a third party, or to an event of force majeure within the meaning of article 1218 of the French Civil Code, in particular strikes, adverse weather, epidemics, fire, failure of carriers or telecommunications networks, or administrative decisions. Performance of the obligations is then suspended for the duration of the impediment.
Coulange cannot be held liable for temporary interruptions of the Site for maintenance or for technical reasons beyond its control. No provision of the Terms limits the rights the Customer derives from the mandatory provisions of the French Consumer Code.
Article 14 – Use of the Site
The Customer undertakes to use the Site fairly and in accordance with the law. The following are prohibited in particular: automated data collection, the introduction of malicious code, any interference with the operation or security of the Site, and the publication of unlawful, abusive or misleading content. Coulange may suspend access to the Site in the event of a breach.
Reviews posted by customers are subject to moderation. Coulange may refuse or remove any review that is unlawful, abusive or unrelated to the product concerned.
Article 15 – Intellectual property
The COULANGE trademark and all elements of the Site (texts, photographs, visuals, logos, videos, editorial content) are protected by intellectual property law. Any reproduction, representation, adaptation or exploitation, in whole or in part, without the prior written authorisation of Coulange is prohibited.
Article 16 – Personal data
The Customer's personal data are processed in accordance with our privacy policy. The Customer has in particular the rights of access, rectification, erasure, objection and portability, which they may exercise by writing to info@coulange1918.com. The Customer may lodge a complaint with the CNIL.
A Customer who does not wish to receive commercial telephone canvassing may register free of charge on the Bloctel (France) telephone canvassing opt-out list (www.bloctel.gouv.fr).
Article 17 – Complaints
Any complaint should be addressed to customer service: info@coulange1918.com – +33 1 84 60 81 65 – COULANGE INTERNATIONAL SAS, 57 boulevard Pereire, 75017 Paris, France. Coulange undertakes to respond as soon as possible.
Article 18 – Governing law and disputes
The Terms are governed by French law. A Customer residing in another State retains the benefit of the mandatory provisions of the law of their country of residence. In the event of a dispute, the Customer may bring proceedings, at their choice, before the court of the place where they resided at the time the contract was concluded or the harmful event occurred, or before any other court having jurisdiction under the law.
